2. Definitions

*   “Local Stock Items”: Products physically stored in Ghana and available for delivery within 2-5 business days.

*   “Import/Pre-Order Items”: Products shipped directly from international suppliers upon order, with an estimated delivery time of 15-30 business days.

*   “Order”: A customer’s request to purchase goods from FalaaMall.

*   “User,” “You,” “Your”: Any person accessing the Site.

3. Orders, Pricing, and Payment

*   Order Acceptance: Your order constitutes an offer to purchase. We reserve the right to accept or decline your order for any reason, including errors in product description or price, availability, or issues identified by our fraud detection systems.

*   Pricing: All prices are in Ghanaian Cedis (GHS). We strive for accuracy but errors may occur. We reserve the right to cancel any order arising from a pricing error.

*   Inclusive Pricing for Imports: The price shown for Import/Pre-Order Items is all-inclusive, covering the product cost, international shipping, insurance, Ghanaian import duties, taxes (VAT), and local delivery. No additional fees will be charged upon delivery.

*   Payment: Full payment is required at the time of order placement. We accept approved payment methods as listed on the Site. For Pre-Order Items, payment authorizes us to immediately procure and ship your item.

 4. Shipping, Delivery, and Pre-Orders

*   Local Stock Items: We aim to deliver within 1-3 business days in major metropolitan areas. Delivery times for other regions may vary.

*   Import/Pre-Order Items:

    *   These items have an estimated delivery time of 15-30 business days from the order date. This is an estimate and not a guaranteed date.

    *   By purchasing a Pre-Order Item, you acknowledge this timeline and agree to the prepayment requirement.

    *   We will provide tracking information when available. Delays may occur due to international transit, customs processing, or unforeseen events, for which we are not liable.

*   Title and Risk: Risk of loss and title for items pass to you upon delivery to the carrier (for Imports) or to you (for Local Items).

 5. Returns, Refunds, and Cancellations

*   Local Stock Items: You may request a return within 7 days of delivery for items that are unused, in original packaging, and in resalable condition. Refunds will be issued to the original payment method, minus any shipping costs, upon receipt and inspection of the returned item.

*   Import/Pre-Order Items:

    *   Cancellation Window: You may cancel a Pre-Order for a full refund within 24 hours of placing the order.

    *   After 24 Hours: Cancellations are not permitted as the order will have been processed with our international supplier.

    *   Non-Delivery Guarantee: If your Pre-Order Item does not arrive within the communicated 20-business-day window, you are entitled to a full refund upon request.

    *   Damaged/Defective Imports: Contact us within 48 hours of delivery with photos/video evidence. We will work with the supplier to arrange a replacement or refund.

    *   Non-Returnable Items: For hygiene and safety, certain items (e.g., personal care products, underwear) cannot be returned unless defective.

 6. User Conduct and Accounts

You agree not to use the Site for any unlawful purpose. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.

 7. Intellectual Property

All content on the Site (logos, text, graphics) is our property or licensed to us and is protected by copyright and other laws. You may not use it without our express prior written permission.

 8. Limitation of Liability

FalaaMall shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any products procured, including but not limited to damages for loss of profits, data, or other intangible losses.

 9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions.

 10. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes by posting the new Terms on the Site. Your continued use after such posting constitutes acceptance.
